Terms of Trade


General Conditions for the supply of services (effective 1 April 1997)

These conditions shall apply to all services offered by Inter-Freight (“the Seller”) to the purchaser of such services (“the Buyer”).
  1. Payment is due on the 20th of the month following the date of delivery of the goods by the Seller to the Buyer unless otherwise specified. No payment may be withheld for any credits sought.
     
  2. Payment not paid by the due date shall be considered an overdue account and shall bear interest at 2.5% per month compounding monthly from the due date until the date of actual payment. All legal and other collection costs incurred seeking recovery of outstanding debt from customer, is payable by the customer. In the event of an overdue account the Seller may without prejudice to any other rights of the Seller under these conditions or otherwise at law or in equity;
    1. postpone further freighting without notice until payment is made
    2. hold any vehicles presently being situated on the Sellers premises or vehicles
    3. take all legal action necessary to recover payment
       
  3. For all services provided by the Seller, the total liability of the Seller whether in tort (including negligence), contract or otherwise for any loss, damage or injury arising directly or indirectly from any defect in services provided by the Seller or any other breach of the Sellers obligations shall in any case be limited at the Sellers option, except where statute expressly requires otherwise, to the lesser of the purchase price of the services complained of, the cost of repairing or replacing the damaged goods or the actual loss or damage suffered by the Buyer. The Seller shall not be liable for any consequential indirect or special damage, loss or injury of any kind suffered by the Buyer or any other person.
     
  4. Subject to any further rights the Buyer may have under the Consumer Guarantees Act, 1993, the Seller shall give credit or partial credit for delivery short provided, only on the condition that the claim is received by the Seller within 24 hours after the expected delivery time and that the cause of the delivery short was in no way the fault of the Buyer.
     
  5. For the purposes of Section 43 (2) (a) of the Consumer Guarantees Act, 1993, these terms and conditions shall be deemed to form an agreement in writing between the Seller and the Buyer upon acceptance of the services by the Buyer.
     
  6. The Seller shall not accept responsibility for any loss or damages to the goods, the property of others, held or stored within or on the Sellers premises or vehicles for any purpose whatsoever (except where required under Carriers Liability). The said property shall be accepted into the Sellers custody at “owners risk” and it shall be the responsibility of the owner of the goods to arrange insurance protection of these goods, unless insurance cover is specifically requested in writing at the time of requesting delivery.
